FLSA Collective Action: Offshore Helicopter Crews Misclassified Under a Day Rate

A client who worked as an offshore helicopter hoist operator came to us after his employer withheld his final paycheck — about $2,000 — when he left. Investigating his claim, we discovered the company had been improperly paying its helicopter crews (hoist operators, rescue divers, and paramedics) a flat day rate, even though they worked 14 consecutive days per hitch and were required to remain on location for the entire shift. We brought a collective action under the Fair Labor Standards Act on behalf of all current and former crew members. Each crew member who opted in recovered between roughly $5,000 and $40,000, depending on how long they had worked under the unlawful pay policy.

Louisiana Penalty Wages: Over $100,000 Recovered for 14 Construction Workers

We represented a group of 14 Hispanic construction workers whose employer fired the entire crew as soon as an out-of-state project was finished — apparently hoping to avoid paying their final wages. Using Louisiana’s wage-payment and penalty-wage laws, we recovered more than $100,000 in unpaid wages and penalties for the workers.

Louisiana Unpaid Wages: Trial Win for a New Orleans Security Officer

A security officer in New Orleans was denied payment for his unused vacation — about $400 — when his out-of-state employer closed its Louisiana offices. We sued, took corporate depositions in Michigan, and tried the case. The court awarded him his unpaid vacation, an additional $9,000 in penalty wages, and a separate award of attorney’s fees.
